Purpose of This Policy
This policy ensures the safety of passengers, drivers, and other road users by setting strict rules for the use of mobile phones and electronic devices while driving or operating company vehicles. It supports compliance with UK law, company safety standards, and the expectations of professional passenger transport services.
Scope
This policy applies to:
- All coach drivers employed by the Landmark Coaches Limited and/or Landmark Vehicle Hire Limited (full-time, part-time, agency, or contracted)
- Any company-owned, leased, or hired vehicle
- Any mobile phone or electronic communication device, whether company-issued or personal
Legal Requirements
Under UK law, it is illegal for a driver to:
- Hold a mobile phone or device while driving
- Use a handheld device while the engine is running, including when stationary in traffic or at lights
Penalties include:
- 6 penalty points
- £200 fine
- £2,500 fine if you are a coach or lorry driver
Possible points on your driving licence and/or possible dismissal for gross misconduct.
General Policy Rules
Prohibited Use While Driving
Drivers must not:
- Hold or use a mobile phone for calls, texts, messaging apps, emails, or social media
- Use the phone as a sat-nav unless it is mounted and set before departure
- Handle the phone for any reason while the vehicle is moving or the engine is running
- Wear earphones, Bluetooth earpieces, or headphones
Any breach may be considered gross misconduct.
Permitted Use
Drivers may:
- Use a hands-free system (factory-fitted or company-approved) for essential operational communication only
- Use the phone when the vehicle is safely parked, engine off, and handbrake applied
- Use the phone in an emergency to contact emergency services if it is unsafe to stop
Company-Issued Devices
Where a company phone or tablet is provided:
- It must be used strictly for work-related communication
- It must remain secured in a cradle or storage compartment while driving
- Drivers must not install personal apps or use the device for non-work purposes
Navigation Devices
If using a mobile phone as a navigation aid:
- It must be mounted securely before the journey begins
- The route must be programmed before departure
- Drivers must not adjust the device while driving
- Voice guidance should be enabled to minimise distraction
Breakdowns, Delays, and Emergencies
Drivers may use a mobile phone to:
- Contact the operations office
- Request assistance
- Communicate with emergency services
This must only be done when:
- The vehicle is safely stopped, or
- The situation presents an immediate danger to life
Passenger Interaction
Drivers must not:
- Use mobile phones in view of passengers while driving
- Engage in personal calls during duty hours
- Allow passengers to distract them with mobile devices
Professional conduct must be maintained at all times.
Monitoring and Compliance
The company may:
- Review phone records for safety investigations
- Conduct spot checks
- Use telematics or CCTV to monitor compliance
Failure to follow this policy may result in:
- Formal warnings
- Suspension
- Dismissal for gross misconduct
Driver Responsibilities
Drivers must:
- Read and understand this policy
- Keep phones stored safely while driving
- Report any incidents or near misses involving distraction
- Ensure hands-free equipment is functioning before departure
Management Responsibilities
Managers will:
- Provide training on safe device use
- Ensure vehicles have appropriate hands-free equipment where required
- Investigate any breaches promptly and fairly
